Screw the IRS, this is *MY* day!

However, according to Beth, today is also known as Buy A Gun Day. I can dig that!

“Democrats believe every day is April 15. Republicans believe that every day is July 4.” — Ronald Reagan

I want to keep my money
And give away absolutely nothing
To the government who moderates my spending
and obliterates depending on what time of the year
brutality is near

in the form of income tax
I’d rather take a fucking ax
to my face, blow up this place

with you all in it, I’d do it in a minute

If I could write off your murder
I’d save all of my receipts
because I’d rather you be dead
than lose a tiny shred of what I made this fiscal year

I’d rather you be dead than ponder parting with my second home
I’d rather you be dead than consider not opening a restaurant

I’d rather you be dead
I’d rather you be dead

Prepare the laser-beam
I’m gonna use it tonight

Engage the laser-beam
It’s gonna end your life

I’m gonna use it tonight

If I could write off your murder
I’d save all of my receipts
because I’d rather you be dead

I’d rather you be dead than ponder parting with my second home
I’d rather you be dead than consider not opening a restaurant.

Big thanks to Beth for the reminder. I love love *LOVE* Metalocalypse!

As I indicated in a previous post, it really burns my hide to see senior citizens get taken advantage of. A friend of mine who works in the insurance industry in Georgia sent me a link from the Atlanta Journal-Constitution with an article about a shady insurance agent who swindled some folks out of their Medicare coverage and/or Medicare supplemental coverage:

The sales agent said he worked for Medicare. He really worked for a private insurer. And, after he came to Dorothy Consalvo’s Stockbridge home and signed her to a new insurance plan, one she thought would enhance her existing benefits, the 81-year-old said she was shocked to find she had inadvertently given up her longtime Medicare coverage.

Up the road in Norcross, another agent talked Violet and Carroll Cox into signing up for a private Medicare plan at the low cost of $7 a month. They say they were told it would give them the same coverage as their supplemental insurance. It didn’t. “This agent lied all the way,” Violet Cox contends.

It’s a crying shame! If you have loved ones who are “a little on in years,” I would suggest keeping a printout tucked away somewhere with their coverage plan details and any uncovered or out-of-pocket expenses (if any) listed. Most insurance companies have this information accessible via a website, or a quick call. Handy information to have, not just in times of (medical) need …

This is a post from Nicki Faulk’s Birthplace of the Process of Illogical Logic

Copyright © Nicki Faulk · All Rights Reserved

Insurance swindlers

As someone who’s been victim to identity theft, my heart goes out to Raven and her family. She recently posted about her family’s findings about her grandfather (now deceased) who was being abused by his caretaker. That in itself is heinous, but to add insult to injury, his caretaker had also stolen his identity and depleted his savings, writing checks and using his credit cards. Reading her story infuriated me, not only bringing back my personal memories dealing with FuckHead, but also in thinking about how I would feel if my beloved Gramps had been treated that way by one of his caretakers.

An open call for help

Those who have been keeping up with this journal over the past week or so are already familiar with the situation I am in, for the most part. For anyone else, here is an overview. I did not put in a cut, as I really need everyone to see this.

My grandfather died at the age of 94 about 8 days ago. This followed an emergency trip to the hospital, where it was found that he had bled out through an intestinal tear. My parents decided to put him in hospice care rather than subject him to radical or invasive procedures, which was in accordance with his wishes. He died about 18 hours later.

At this point my parents started trying to put his affairs in order. As they filled out the death certificate, a nurse took my mother and her sister, my aunt, aside to tell them that she believed my grandfather had been severely abused by his caretaker, and if they had been able to save him, she would have personally intervened to keep him from being sent back to his caretaker to spare him a great deal of pain. He had bruises in several stages of healing all over his body, and possibly worse injuries as well.

The hospital records, over 100 pages corroborated this abuse pattern over the past few years. However, Texas, the state where he resides does not have a mandatory abuse reporting policy apparently, so no one bothered to report it to adult protective services. Then, as my mother tried to continue putting his affairs in order, she was stunned to realize that this same caretaker had used my grandfather’s credit cards to make purchases and drained his entire life savings to the point where he did not even have any money to live on. Even two days after his death, this woman was still writing checks in his name, obvious forgeries of his signature on each.

This explained to us several references in his letters about being tired of living and wishing God would take him away from his pain. None of us knew this was going on, and apparently even my grandfather’s financial advisors noticed the pattern but did not see fit to notify the rest of the family for whatever reason.

My family contacted the Lubbock, Texas police and were told flatly that they refused to get involved at all and would not pursue the case or try and find the caretaker. They contacted adult protective services and found out that the police should have suggested an autopsy to prove abuse, but it was too late as my grandfather had been cremated. Apparently they can only intervene if there is a live person to question or an intact body. The attorney they found also basically told my mother that this was not a winnable case. After contacting the credit card companies about the theft of my grandfather’s identities, one company told my mother that they too refused to get involved at all.

At this point, we just want to see the caretaker prosecuted for her fraud, have the bills in my grandfather’s name cleared and make sure the woman does not do this to anyone else’s loved ones. The money, my grandfather’s savings that he had been building since just after the Depression, when he first started building his accounting firm is probably not retrievable, though it would be wonderful if it was.

This is an open request for help from me and my family. If you have any suggestions at all of how we can at least get someone to help us on this, we would be very grateful. Please re-post this to lists and pass it along, as any help at this point would be welcome. We are drowning in bills that were run up by this caretaker, and the police, lawyers, and credit company will not help us. The only people who have aided us are the hospital staff, who have come forward with statements. However, this does not really help since the police will not listen and my family does not know where else to turn.

I can’t pretend to know how Raven is feeling. I know it has got to be frustrating as hell when local authorities, credit companies, and legal venues are not helping in even pursuing possible prosecution of the caretaker! That woman took the old man for everything he had (and physically abused him on top of that!!) and left a mountain of bills in her financially destructive wake for the family to sort out.

Anyone with ideas or advice for Raven and her family, please take a moment to leave a comment on her post.

There are a lot of things I wanted to cover today, unfortunately I wasn’t able to finish this post prior to class this afternoon, so bear with me … there’s a lot here.

Those of you who are local I’m sure have been following the story of the busload of Marines that overturned Sunday. They were from E Co., Anti-Terrorism Battalion, 4th Marine Division, returning from a weekend training exercise. I read this morning about Lance Cpl. David Miles, the Marine that passed away Monday afternoon from his injuries. However, even in death he still served others.

“According to his mom, he was very adamant about (donating) his organs … so the mom is very adamant about carrying out his wishes of harvesting as many of his organs as possible.”

Courtesy of The Birmingham News.

No doubt about it in my mind, he’s a hero. Courtesy of Villainous Company, here’s another tale of heroism: America’s Female Warriors Show Bravery, Loyalty. Greta highlighted a brave soldier’s father that she has met through Soldiers’ Angels: Robert Stokely, a fellow SA member and father of Mike Stokely who proudly gave his all for his country in Iraq.

Honestly the grace and bravery that our finest men and women exhibit every day never cease to amaze me. Too bad the liberal media doesn’t show them more often!

On Cookie’s site earlier today, I read a story about a couple of vets experiencing problems with Verizon:

Verizon Cancels Returning Marines’ Cellphones, Gives Their Number Away, Charges Them $500

Two Marines, a husband and wife, found Verizon had an unpleasant welcome-home gift waiting for them when they got back from serving in Iraq: canceled cellphones, a $500bill, and their phone numbers were given to other people. Under the Service Members Civil Relief Act, when a soldier goes off to war, they’re able to send their deployment letters to their service companies and get their service put on hold. Apparently in the case of Haley Katz and her husband, that letter wasn’t good enough. When they complained and reached a manager, the manager told them ” it was their fault they owed the money”, and then hung up on them. Read their letter as published in Stars and Stripes, inside…

At 3:30 a.m (Iraq time), [recently], my husband and I called Verizon Wireless to reactivate our phones, as we are returning home [from Iraq] soon and wanted to catch the company during its business hours. Upon speaking with a customer service representative, it became apparent that Verizon not only suspended our contracts, it disconnected our phones and gave our numbers away to other customers.

What is truly amazing is that the company took the letters our commanding officers signed regarding our deployment dates, and deemed the letters not worthy of suspending our contracts. It continued to charge us for those months without notifying us and when we did not pay, it disconnected the lines.

Long story short, when we called to reactivate our phones they told us our numbers no longer existed and that we owed them nearly $500!

When we asked to speak to a manager, we were told nothing could be done. When we did actually speak to a manager we were told it was our fault that we owed the money. The manager then proceeded to say “We’re sorry but nothing can be done for you. Goodbye.”

We were hung up on … in Iraq … at 3:30 in the morning. Real professional.

We spoke to another manager who was courteous enough to recredit our accounts and cut all remaining ties with their service. We are no longer with Verizon Wireless.

For all of the soldiers, sailors, Marines and airmen out there, make sure you are checking up on the status of your accounts. Apparently, a letter from your command stating you are deploying is not enough these days. And aside from seeing service members off at Marine Corps Air Station Cherry Point (N.C.), I am not sure what else they are looking for.

Marine 2nd Lt. Haley Katz
Camp Fallujah, Iraq

 I’ve heard horror stories about Verizon and their crappy customer service for years, but this takes the cake!

And speaking of human depravity, there’s the Berkley protesters. We’ve all heard of this one, right? Today, Rachel Lucas gave plenty examples of and commented on the ‘fine minds’ (and I say that lightly!) objecting to our nation’s finest.

Somebody please put these morons out of our misery!

Moving on to cooler (and more intriguing) things … a Starbucks employee donates a kidney to her customer. In today’s Mental Floss blog postings, a UAB study is mentioned where researchers are studying the use of scorpion venom in cancer medication. (YAY us!) Also, one of my fave sci-fi blogs, IO9, tells me that there is a remake coming for one of my favorite ‘B’ movies, Attack of the Killer Tomatoes! And last but not least, a funny bit courtesy of A Bama Blog: How to tell that you’ve ticked off an engineer.

I think that just about covers it.

Oh … before I forget … anyone going to OmegaCon this weekend?

I had been holding off on this post for several days for many reasons, but the first and foremost because when I’m angry, I’m not at my best … and this whole ordeal has made me VERY angry. One of the cardinal rules of blogging is not to blog when angry, so I tried at least. Secondly, because this played out over the course of several days and I had wanted to try to post everything at once, not have to come back every day and post updates. But oh well, I do what I can, so here goes:

.

Jim’s been looking at cars for a while. I had been carpooling over to UAB with several friends who lived near us and worked a few buildings down from me. Jim had finally decided on getting a Hyundai. We’ve been very happy with my Santa Fe, and honestly when looking at his choices to shop for, I didn’t see anything that I liked better.

We had planned on using Jim’s old Stratus as a trade-in. The engine went out some time ago, but was still worth a good bit regardless (to my surprise). The car was in his ex’s name, but in the terms of their divorce, the car became Jim’s and he had been making the payments, and was to be switched to his name once it was paid off. He only had a couple payments left. His ex had been pushing for over a week to go ahead and pay it off before we went car shopping. (Odd, I thought.)

Day 1: Friday, May 18th

Jim came by to pick me up from work around 1pm. We got to Serra Chevrolet around 1:40 and walked around their Hyundai lot for about 5-10 minutes before being spotted and greeted by “Frank”, one of the sales guys — apparently he had come up there on his day off, and appeared “thuggish” (for lack of a better word, honestly!).

Jim told him what he was looking for and Frank showed us around a few cars. Jim had been eying the Tiburon for several days and seemed to really have his heart set on it, so we took one for a test drive. It purred beautifully and drove very well. The fact that it was brand new concerned me a bit, but I knew that if I co-signed, Jim shouldn’t have a problem getting it. We talked things over and Jim told Frank that we liked the Tiburon and wanted to buy it. Frank invited us into the Hyundai office to start on the paperwork. The three of us spoke for a bit and Frank took down all of our personal information. We expressed to Frank what price range we had been looking for (in monthly payments), and explained about Jim’s car, that it doesn’t run, only has a couple payments left, etc. Frank says it’s fine and Serra will buy it from him and pay it off. After that, we sat and waited. Frank walked in and out of the office several times, went in to see his manager several times, we filled out more paperwork, and didn’t see Frank again for about 2 hours.

During that time, we did what we could to amuse ourselves to help pass the time by walking around the lot several times, coming in around 3 to try to call Jim’s ex. We had never been able to reach her that day and left several messages. Jim was going to need the financing company’s name so he could get the title to Serra and get the final payoff amount verified. After 4 o’clock, Jim gave up leaving messages because she wasn’t picking up the phone, nor could he or I remember if she could even access them if she was out of minutes on her cell phone. At this point I’m getting antsy and Frank appears and asks us to follow him to the main Serra office. We sat on the couch and waited 2 more hours – during this time, Jim tries to reach his ex several more times, she never answered and he didn’t leave any messages. (He and I had already left 4!)

Between this point and 7, Frank tells us a couple times “It won’t be long” or “You’re almost done” … but he never could tell us any specifics. 7 o’clock rolls around and it’s getting dark. By this point, I’m starting to get a headache and I’m mad as all hell because no one has told us anything about our application, or even what stage it is in. At 8:30 Jim and I are getting ready to hand the Tiburon keys back to someone and just leave, when we are ushered into a tiny office with the financial manager, “Mark”. It turns out that the delay had been in dealing with the banks/lenders … a “black mark” was found on Jim’s credit report and Mark had been trying to find a way to get around it.

Now, I knew that Jim had cosigned on his ex’s truck … that was years ago. Supposedly she had been keeping up the payments and been paying everything on time. I had begun to suspect otherwise when it was repossessed a few months ago. She claimed not to know why and said that she figured that it was because she was a few weeks late. (Yeah, right.) It’s since been paid off, but what we found out Friday was that she had been late on so many payments so many times that it was repo’d after “several advanced warnings” (directly quoted from the lender’s note). In fact, Jim’s credit was quite good except for that. Mark told us that several lenders did not want to deal with us because of that, but he was able to convince two otherwise because Jim had paid off previous (school-related) debts through some sort of school loan consolidation. Mark said that was a good thing and it was enough (plus my co-signing) to get the loan approved.

What Mark DIDN’T know was the monthly payment range we had been looking for. The lender he recommended had the monthly payments set to twice what we were willing to pay. He also knew nothing about the Stratus being used as a trade-in, or that Frank had said Serra would pay it off for us. So after seeing that, I stated that it was unacceptable and asked if Frank had relayed the information we had given him earlier. To no surprise, he hadn’t. So more figuring and negotiation had to be done. By this point, both Jim and I had expressed our unhappiness with the lack of communication by the sales staff and that we had basically been there all day with nothing to show for it. They were getting ready to close up for the night!

After a bit more negotiation, we finally agreed on a price. I wasn’t thrilled with it, but Jim loves the car and to me he is worth it. Serra would still pay off the Stratus and we could get back to them with the final payoff amount and they were fine with that. Jim had already given his ex half of this month’s payment, and was told by Mark not to pay anything, that Serra would handle it. Ok, fine by us. By this point it’s nearly 9 o’clock and I left Jim to go get Jessie. She and I went straight home, and Jim was left to finish up gathering paperwork and details – or so I thought.

I got home and Jim’s ex had left a very heated (UGLY!) message on our machine telling Jim that he was a “horrible father to do that to his daughter” and that he didn’t deserve her, blathering on about how we didn’t leave any messages after 4pm and she knew she hadn’t been picking up the phone, but we could have left her a message to let her “know what’s going on”…

Hello!???! Try picking up the fucking phone once in a while!!! We only tried calling every half hour, you stupid cunt!

Aaaaaanyways, I get Jessie home and in bed and I waited up for Jim. I was already riled up from his ex being a total fuckhead, and Jim proceeds to tell me that he was going to have to come back Monday to get the three scratches I saw (one of them DEEP!) painted, get the car cleaned (they didn’t want to do it Friday night), and get our copies of the paperwork. They had required several pieces of paperwork from me and I was to fax that in Monday morning, so it was strange to me, but didn’t seem totally unreasonable. (I was tired and hungry, and clearly NOT thinking or I would have gone BACK to the dealership and stayed until everything was TAKEN CARE OF!)

Day 2: Monday, May 21st

Ok, so I had to fax in a copy of a letter of employment (no biggie, I had just started a new job, so I could understand this), a copy of my phone bill (WTF? Because I have an unlisted number???), and a copy of mail – they asked that it be a bank statement. I was very uncomfortable faxing these in because it basically gives them access to our utilities and my bank account. Jim had brought up the question of identity theft/fraud, as did several other customers there, and the consensus is: we don’t trust them and will NOT shop there again.

Monday afternoon Jim comes home, they have not cleaned the car because it couldn’t be painted -– apparently the painter only comes in on Wednesdays. WTF??? Why the hell couldn’t Frank tell us this Friday night? Also, he told Jim that he couldn’t give him the paperwork because they mail that to you. Again, WTF??? At Driver’s Way, you got your paperwork right then and in a neat little binder and everything … what the fuck is this muddled up bullshit?

Day 3: Tuesday, May 22nd

Jim finally gets a hold of his ex … she bitches and moans about Friday night and how WE inconvenienced HER. He had spoken to the financing company for the Stratus and finds out that this month’s payment is already late and they are wanting it right THEN, or they are repo’ing the car. He also finds out that several payments have been late and there are several large late fees that are due. She claims not to know anything about it. (What a fucking surprise.) He then tells her that Serra agreed to take over the Stratus payments and that he would need the half month’s payment that he gave her a week or so back. She told him that she didn’t have it anymore and that she wouldn’t be able to get it back to him for another week or so.

What I’d like to know is: Where the hell is that money? And what about those late payments? Jim always gave her the payments far enough in advance so she could send them in and them be ON TIME. So what the fuck has she been doing with his money!???!

I know one thing, I’ll be glad when this is over and she can’t milk him for any more fucking money. Because as far as I’m concerned she needs to get off her ass and support HERSELF for a change!

So Jim calls Serra to give them an update on the Stratus and the payoff amount. The financial company was wanting him to Western Union the money in. Frank told him that if he wanted to, he could put down a “down payment” to put off the financing company and Serra would pick up the car within a day or so.

WTF? I think this guy’s seriously a scammer because even though Mark wasn’t there, Jim spoke to someone else and they said that since Serra had already agreed to pay it off and it was in writing, so he didn’t need to pay anything. Who’s to say Frank didn’t want to line his own pockets?

Day 4: Today

Jim was supposed to take the car in today to be painted, but considering he’s been at the dealership for the last 3 days straight, he had to stay in for work. He’ll go next week once the shit with the Stratus has already been handled. I think they are supposed to get it today or tomorrow.

Needless to say, I’ve been very unhappy with the whole ordeal and though I suppose it could have come out worse, I don’t appreciate their sales people treating us that way — basically ignoring us once they had what they wanted. Both of us have called over the past few days and getting someone to call us back is like getting teeth pulled.

So now here we are –- still no paperwork, still no paint job, the car still hasn’t been cleaned, and I SERIOUSLY regret buying from Serra. Unfortunately they are the only authorized Hyundai dealer in the metro area — or within 3 hours of here for that matter — so if we ever need work done on our cars, we will have to take them there. Just fucking great … let’s hope their servicemen have more brains and tact than the salesmen. (they’d better, or they’ll be hearing from ME!)

You know, had I had my choice, I would have gladly bought from Driver’s Way again … but unfortunately they had no new Tiburons and wouldn’t have any for a while.

I will never EVER do business with Serra Chevrolet/Hyundai/Whatever again. Next time I’ll go back to Driver’s Way, thank you.

Five years ago, in the Onion:

“It’s criminal,” RIAA president Hilary Rosen said. “Anyone at any time can simply turn on a radio and hear a copyrighted song. Making matters worse, these radio stations often play the best, catchiest song off the album over and over until people get sick of it. Where is the incentive for people to go out and buy the album?”

    […]

RIAA attorney Russell Frackman said the lawsuit is intended to protect the artists.

“If this radio trend continues, it will severely damage a musician’s ability to earn a living off his music,” Frackman said. “[Metallica drummer] Lars Ulrich stopped in the other day wondering why his last royalty check was so small, and I didn’t know what to say. How do you tell a man who’s devoted his whole life to his music that someone is able to just give it away for free? That pirates are taking away his right to support himself with his craft?”

Yesterday, in the Los Angeles Times:

With CD sales tumbling, record companies and musicians are looking at a new potential pot of money: royalties from broadcast radio stations.

For years, stations have paid royalties to composers and publishers when they played their songs. But they enjoy a federal exemption when paying the performers and record labels because, they argue, the airplay sells music.

Now, the Recording Industry Assn. of America and several artists’ groups are getting ready to push Congress to repeal the exemption, a move that could generate hundreds of millions of dollars annually in new royalties.

Mary Wilson, who with Diana Ross and Florence Ballard formed the original Supremes, said the exemption was unfair and forced older musicians to continue touring to pay their bills.

“After so many years of not being compensated, it would be nice now at this late date to at least start,” the 63-year-old Las Vegas resident said in Milwaukee, where she was performing at the Potawatomi Bingo Casino. “They’ve gotten 50-some years of free play. Now maybe it’s time to pay up.”

Rather sadly, the Onion is becoming the new Nostradamus — only a lot more accurate.

(via eukaryaeukarya)

All I can say is: it’s about damned time!

Scrushy’s name removed from Jeff State’s Hoover campus

HOOVER, Ala. (AP)– Former HealthSouth CEO Richard Scrushy’s name has been taken off the Jefferson State Community College campus in Hoover. The Richard M. Scrushy Campus is now the Shelby-Hoover Campus, and Richard M. Scrushy Hall will now be called the Math and Sciences Building.

The campus opened in 1993 as the college’s “Shelby Campus” but was renamed for Scrushy in 1998 after he donated $2 million, enabling the construction of the building that also was named for him.

College spokesman David Bobo said the decision to rename the campus and building was not because of Scrushy’s legal troubles, including his conviction in a government corruption case involving former Gov. Don Siegelman.

“That’s really none of our business, and what we have always focused on is the needs of our students,” Bobo said.

The name changes were made to better reflect the campus’ location and the kind of instruction offered to students in the building, he said.

Scrushy is an alumnus of Jeff State.

“He’s been wonderful to us, and if it wasn’t for Mr. Scrushy, more than 30,000 students wouldn’t have been able to attend that campus,” Bobo said.

OK, great … what took so long? And will we be seeing similar changes to the Richard M.
This might just be the best send-up of the MAFIAA’s anti-piracy ads ever, making the case for buying pirate copies, rather than being stuck with DVDs that complain about piracy in unskippable, condescending PSAs. JPEG Link, Mirror (via Wonderland)

Amen!! That’s one of the things about buying movies nowadays — if you buy them LEGALLY, you’re forced to sit through unwanted previews, anti-piracy ads and skits, lame FBI warnings, et. al. and you can’t bypass the shit! WTF am I paying for then????

Screw unrated versions and extras, let me buy a DVD where I can skip through all that crap!
